Gold and silver are valuable non-ferrous precious metals that play an extremely important role in national economic construction. In this regard, the State Council has formulated the "Regulations of the People's Republic of China on the Administration of Gold and Silver." The "Regulations" stipulate that the state implements a policy of unified management and centralized procurement and allocation of gold and silver. For any gold, silver, and their products declared for export, the exporting unit must go through export procedures with the "Gold and Silver Products Export Permit" issued by the People's Bank of China. Any violations of the "Regulations" shall be penalized by the Customs, the People's Bank of China, and the administrative authorities for industry and commerce according to their respective responsibilities.
The management of the import and export of gold and silver products includes the following states of gold, silver, and their products: gold and silver from mineral production and smelting by-products; gold and silver bars, ingots, blocks, and powders; gold and silver coins; gold and silver products and products of gold-based and silver-based alloys; gold and silver contained in chemical products; and gold and silver contained in scrap, waste residue, waste liquid, and waste materials. Exported jewelry with gold or silver inlay where the jewelry itself is the main value is not included in this management scope.
The basic procedures for exporting gold and silver products are as follows: When declaring the export of gold, silver, and their products at Customs, an "Export Permit for Gold and Silver Products" must first be obtained from the People's Bank of China or its authorized institution. Customs will clear the export declaration based on this permit. For gold and silver raw materials imported from abroad for processing into finished products for export, the import customs declaration documents must be used to register with the People's Bank of China after import. When the finished products are exported, an "Export Permit" will be issued accordingly for customs declaration and export.
Gold and its products brought into the country by passengers should be limited to personal use and a reasonable quantity. After approval by Customs, they will be released duty-free. For gold and its products exceeding personal use and reasonable quantity, Customs will release them upon payment of duty based on the approval document from the Head Office of the People's Bank of China.
Gold, silver, and their products imported by domestic units carried in by passengers, as well as donated gold, silver, and their products, must go through customs declaration procedures using a valid approval document from the Head Office of the People's Bank of China within its period of validity.
Gold and silver imported for processing with supplied materials must hold an approval document from the Head Office of the People's Bank of China or its authorized branch when declaring import to Customs.
